Divorce:
  • Divorce Related Issues: These cases frequently address issues regarding shared or sole parental responsibility, child custody, child support, visitation, relocation of residency out-of-state, alimony, equitable distribution of property and attorneys fees and costs associated with the litigation.

Post Divorce Modification: After the divorce is final, some clients want to change the terms of the Judge's Final Judgment. Typical changes include the following:
  • Change of Custody: Some clients, who were not awarded custody of the children, ask the Court to change custody after the divorce is final.
  • Relocation: Many of these cases involve a request by the spouse with custody of children to relocate his or her residence outside the State of Florida.
  • Increase or decrease child support: As income increases or decreases, clients seek increases or decreases in an obligation to pay child support.
  • Increases, decreases or termination of alimony: The law permits increases, decreases and termination of alimony obligations under certain circumstances.

Domestic Violence Injunctions: At our Firm, we take domestic violence issues seriously. There are injunctions prohibiting acts of domestic violence that are available to protect victims from further acts of domestic violence. The Firm supports the goal of "Zero Tolerance" of domestic violence.

Child Abduction Cases: These cases generally involve efforts to get children back into the arms of a custodial parent after the child has been wrongfully abducted. Children can disappear into the underground forever. To try and obtain an expeditious return of the child, the firm maintains relations with local, state, federal and international law enforcement agencies which frequently assist in the child's recovery.

Child Support: Our firm assists clients in determining the amount of child support that may be required to be paid in a divorce or modification action. The Florida Statutory Guidelines are explained as are the obligations of the non-custodial parent to contribute to certain non-insurance covered expenses of the child, to the cost of a life insurance policy to secure the child support obligation and, possibly, to the cost of day care. Income deduction orders, similar to garnishment orders, can be entered requiring the payor's employer to deduct the court ordered amount of child support directly from the payor's paycheck. In some circumstances, rotating custody can reduce the amount of child support the non-custodial parent may be required to pay.

Custody and Visitation: During the divorce, the firm advocates the position of the client regarding custody or visitation, both on a temporary basis during the litigation and for final purposes. The firm has professional relationships with experienced forensic custody evaluators to assist the client in this regard. After the divorce is final, the firm can be retained to ask for a change in custody or a visitation schedule.

Paternity Determinations: A lawsuit to determine the legal father of a child is a family law related legal matter. Both the biological mother and the biological father can initiate a lawsuit to establish paternity.

Prenuptial Agreements and Postnuptial Agreements: Our Firm handles both Prenuptial and Postnuptial Agreements. Prenuptial Agreements involve people who are not yet married who wish to resolve all financial issues that may arise in the unlikely event of a future divorce. Postnuptial Agreements are drawn up after marriage so both parties involved can enter into financial and other agreements in the effort to put financial issues to rest in the event of a divorce. These agreements free up the couple to focus on efforts to keep the marriage together.
